Bankruptcy

The Firm has extensive experience in representing creditors in all types of business and personal bankruptcy filings (Chapters 7, 11, 12 & 13).  Our attorneys routinely seek and obtain relief from the automatic stay allowing our creditor clients to obtain and sell their collateral, obtain and file reaffirmation agreements, which allow our client to continue to accept and apply loan payments and preserve personal liability even if the debtor is discharged, and object to and resolve plan confirmation issues ensuring that clients receive the most advantageous treatment in the debtors’ plans.

In more complex matters, our attorneys are well-versed in objecting to the debtors’ discharge or the dischargeability of the debtors’ debts to our clients when warranted under law, as well as filing and defending adversary proceedings involving our clients, including, but not limited to, proceedings by a Trustee seeking to “claw back” pre-petition payments made to our clients.
